Derived pension rights (Hinterbliebenenrente and Versorgungsausgleich)
Derived pension rights arise because pension law connects one person's claim to another person's insurance or pension record. German examples include Hinterbliebenenrente (survivor pension) after death and rights transferred through Versorgungsausgleich (pension equalization) at divorce. They have separate eligibility rules and do not pass through an estate like an inherited bank balance [1][2].
Why it matters
“My spouse's pension” can mean three different things: the spouse's own lifetime benefit, a survivor claim after death, or pension rights divided by a family court at divorce. The recipient, timing, income tests, duration, and tax treatment differ.
Two mechanisms

Worked classification
Assume one spouse dies with a statutory-pension record and a securities account. The surviving spouse may qualify for a widow's or widower's pension under SGB VI. The securities account, by contrast, follows ownership, contract, and succession law. Naming someone in a will can affect the estate, but cannot substitute a different person into the statutory survivor-pension rules.
If the couple divorces instead, the family court generally handles pension rights accrued during the marriage through Versorgungsausgleich. No death and no inheritance are required [2].
Don't confuse with estate beneficiaries
An Erbe (heir) succeeds to estate assets and liabilities. A Vermächtnisnehmer (legatee) has a testamentary claim. A statutory survivor pension arises only from pension law, while a divorce transfer arises from the court's pension-equalization decision. One person can hold several roles, but one role does not create the others.
